Cancellation Memo AC 91-57<\/a>.<\/p>\n

The FAA says it is in process of developing a new advisory<\/em> circular. Oddly, the FAA cites its authority to do this as the 2012 FAA reauthorization act, section 336<\/a>\u00a0which actually says the FAA “may not promulgate any rule or regulation regarding a model aircraft, or an aircraft being developed as a model aircraft, if –<\/em>” basically, its a hobby model aircraft. Thus, they will issue a new set of voluntary guidelines.<\/p>\n

SEC. 336. SPECIAL RULE FOR MODEL AIRCRAFT.<\/p>\n

<\/p>\n

(a) IN GENERAL.\u2014Notwithstanding any other provision of law<\/p>\n

relating to the incorporation of unmanned aircraft systems into Federal<\/p>\n

Aviation Administration plans and policies, including this subtitle,<\/p>\n

the Administrator of the Federal Aviation Administration may<\/p>\n

not promulgate any rule or regulation regarding a model aircraft,<\/p>\n

or an aircraft being developed as a model aircraft, if\u2014<\/p>\n

(1) the aircraft is flown strictly for hobby or recreational<\/p>\n

use;<\/p>\n

(2) the aircraft is operated in accordance with a community-based<\/p>\n

set of safety guidelines and within the programming<\/p>\n

of a nationwide community-based organization;<\/p>\n

(3) the aircraft is limited to not more than 55 pounds unless<\/p>\n

otherwise certified through a design, construction, inspection,<\/p>\n

flight test, and operational safety program administered<\/p>\n

by a community-based organization;<\/p>\n

(4) the aircraft is operated in a manner that does not interfere<\/p>\n

with and gives way to any manned aircraft; and<\/p>\n

(5) when flown within 5 miles of an airport, the operator<\/p>\n

of the aircraft provides the airport operator and the airport air<\/p>\n

traffic control tower (when an air traffic facility is located at<\/p>\n

the airport) with prior notice of the operation (model aircraft<\/p>\n

operators flying from a permanent location within 5 miles of an<\/p>\n

airport should establish a mutually-agreed upon operating procedure<\/p>\n

with the airport operator and the airport air traffic control<\/p>\n

tower (when an air traffic facility is located at the airport)).<\/p>\n

(b) STATUTORY CONSTRUCTION.\u2014Nothing in this section shall<\/p>\n

be construed to limit the authority of the Administrator to pursue<\/p>\n

enforcement action against persons operating model aircraft who endanger<\/p>\n

the safety of the national airspace system.<\/p>\n

(c) MODEL AIRCRAFT DEFINED.\u2014In this section, the term \u2018\u2018model<\/p>\n

aircraft\u2019\u2019 means an unmanned aircraft that is\u2014<\/p>\n

(1) capable of sustained flight in the atmosphere;<\/p>\n

(2) flown within visual line of sight of the person operating<\/p>\n

the aircraft; and<\/p>\n

(3) flown for hobby or recreational purposes.<\/p>\n","protected":false},"excerpt":{"rendered":"
