{"id":3408,"date":"2014-12-04T12:43:25","date_gmt":"2014-12-04T20:43:25","guid":{"rendered":"http:\/\/3d.coldstreams.com\/?p=3408"},"modified":"2014-12-04T12:43:25","modified_gmt":"2014-12-04T20:43:25","slug":"faa-appears-to-misrepresent-the-rules-on-model-aircraft-drones","status":"publish","type":"post","link":"https:\/\/coldstreams.com\/3d\/2014\/12\/04\/faa-appears-to-misrepresent-the-rules-on-model-aircraft-drones\/","title":{"rendered":"FAA appears to misrepresent the rules on model aircraft &#8220;drones&#8221;"},"content":{"rendered":"<p><a href=\"http:\/\/diydrones.com\/m\/blogpost?id=705844%3ABlogPost%3A1551726\">FOIA Response Reveals FAA Routinely Misrepresents the Law Regarding Unmanned Aircraft \u2013 DIY Drones<\/a>.<\/p>\n<p>Read the whole article at the link.<\/p>\n<p>Long ago, the FAA issued an &#8220;advisory circular&#8221; (AC 91-57), which is not a rule or regulation, regarding model aircraft. \u00a0Per the link, the FAA has incorrectly interpreted this advisory notice, which clearly states the notice is a voluntary guideline, as a <em>regulation<\/em> concerning model aircraft even though the FAA said in a Court filing that &#8220;compliance&#8221; with the advisory is not mandatory.<\/p>\n<p>The 2012 FAA Reauthorization Act, includes wording that exempts model aircraft from FAA regulations but the FAA seems to be interpreting this law opposite to what the law says.<\/p>\n<p>On a related topic, recent news reports say the FAA has seen an explosive growth in &#8220;near misses&#8221; with UAS craft. But this\u00a0appears to be <a href=\"http:\/\/www.techenstein.com\/drone-reports-2014-the-facts-and-the-fiction\/\">a big stretch<\/a>.<\/p>\n<p><!--more--><\/p>\n<p>The <a href=\"http:\/\/bits.blogs.nytimes.com\/2014\/11\/26\/new-f-a-a-report-tallies-drone-sightings-highlighting-safety-issues\/\">NY Times obtained a spreadsheet<\/a> containing documentation on 194 incidents. I looked through the spreadsheet and see reports of &#8220;drones&#8221; flying at 25,000 feet, drones that carried radar transponders, drones flying at 60 knot airspeeds, and other reports of\u00a0UAS craft at altitudse that are definitely not small model aircraft operations.<\/p>\n<p>The report also includes reports of model aircraft flying at &#8220;50 feet&#8221; near stadiums (which the FAA prohibits on terrorism fears) and over national park service administered lands (an NPS rule) &#8211; <em>these have nothing to do with &#8220;near miss&#8221; situations.<\/em><\/p>\n<p>One report involved airport staff flying a &#8220;drone&#8221; at an airport, coordinating with the air traffic control tower on aviation radio, and operating under the direction of the airport manager &#8211; not an out of control &#8220;near miss&#8221;.<\/p>\n<p>There are also situations in the report that are generally worrisome too.<\/p>\n<p>However, the FAA has distorted the data &#8211; literally <em>gruberized<\/em> the story\u00a0&#8211; in ways that destroy the FAA&#8217;s credibility and turn this report into government sponsored propaganda.
